The conditions under which BluePeak accepts, moves, stores and clears cargo. Read alongside the published fee schedule.
All services are performed subject to the FIATA/FENEX conditions and the BluePeak published tariff in force on the date of booking. Where a written contract exists, that contract prevails for rates only; the operational and penalty provisions below continue to apply.
Indicative rates from the calculator are valid for 7 days and subject to space, equipment and correct declaration. Rates are quoted in USD and exclude duties, taxes and any charge listed in the fee schedule that becomes applicable.
Demurrage, detention, storage, waiting time and truck-ordered-not-used charges accrue automatically once the published free time expires and are payable regardless of cause, save where caused solely by BluePeak. Escalation tiers apply as published.
The shipper warrants the accuracy of weight, dimensions, HS classification, value and the presence of any dangerous goods. Misdeclaration charges up to USD 12,000 per shipment apply for undeclared dangerous goods, plus carrier fines, re-handling and disposal costs.
Liability is limited by the applicable convention (Hague-Visby, Montreal, CMR) unless all-risk cargo insurance is purchased at 0.42% of declared value. Claims must be notified in writing within 14 days of delivery.
Invoices are due 14 days from issue unless credit terms are agreed. Overdue amounts accrue interest at 1.5% per month. BluePeak may exercise a general lien over goods and documents for unpaid charges.
